Examined Patent
The TPI will send the official letter about submitting the required documents and fees, if the patent application is applicable for the formal requirements and patentability criteria.
After the applicant chooses the patent research Office, the TPI will send the file to the chosen research Office. If there is not any negativity on the search report or the negativity could have been changed by the applicant the re-arranged description and claims will send to the same Office or another by the TPI, in order to be examined.
If the research office’s report is positive, the invention will be examined patent. If there would be any negativity, the applicant has right to send the file second and third times to the TPI. And if the result is positive the Examined Patent Certificate will be issued.
At this process the TPI will publish the patent for the third parties attention for 6 months. After issuing the certificate there would be a publication for month about the patent has been issued.
This patent protection covers just an internal protection in Turkey. If the applicant would like an international protection from the application date within 1 year (if there is a priority claim, from this date) at the selected states applications could be filed.
