Trademark Application in Turkey

After approximately 3-5 months from the trademark application before the TURKPATENT, the TURKPATENT examine and evaluate the trademark in terms of the absolute rejection reasons of the Decree Law no. 556. Afterwards if the decision is positive, the trademark will be published for two months on the Official Trademark Bulletin for the third parties opposition/s. If there will not be any opposition, the trademark will be registered by the TURKPATENT and within 3-5 months the registration certificate will be issued. If there would be opposition/s the Turkish Trademark and Patent Office will examine them and if the applicant would like to give counter views against possible opposition/s, they could file a petition, as well. This kind of oppositions may causes the extension of the registration process 4-6 months, or may cause the refusal of the trademark application. If there would be any refusal decision for the trademark from the Departments of Trademarks, the applicant could file an appeal before the Re-Examination and Evaluation Board in two months from the notification of refusal decision.

Third parties could also file an appeal within 2 months against the refusal of the opposition before the Re-Examination and Evaluation Board, as well. This procedure will take approximately 8 months. The Board’s decision will be the final decision and in order to cancel this decision and both parties could file a law suit against the decision of board within 2 months before the courts.

Consequently, if there would be second opposition/s by the third parties, the final decision will be issued in approximately 24 months later.
